3. Hosting

The site and the application services are hosted by IONOS SE, a European company under German law, Elgendorfer Straße 57, 56410 Montabaur, Germany.

Application data is stored on servers located in the European Union. Some technical providers used by Pambe may process data outside the Union: the list of those providers and the applicable safeguards appear in the privacy policy.

4. Nature of the activity

Pambe operates a platform connecting individuals with service providers established in Belgium.

Pambe is not a party to the contracts concluded between Users, nor an employer, nor an agent, nor the provider of the services offered, and collects no payment on behalf of providers. The role and limits of this intermediation are detailed in the terms of use.

5. Intellectual property

The “Pambe” trade mark, the logo, the visual identity, the editorial texts, the site architecture, the databases and the software developments are protected by intellectual property law. Any reproduction, display, adaptation or exploitation, in whole or in part, is prohibited without prior written authorisation.

The extraction or re-utilisation, qualitatively or quantitatively substantial, of the content of the platform's databases is prohibited, including by automated scraping, unauthorised indexing robots or the building of a dataset intended to train an artificial intelligence system.

Content published by Users remains their property. They grant Pambe a limited licence, described in article 8 of the terms of use.

6. Hyperlinks

The platform may link to third-party sites, in particular the websites of the providers listed. Pambe exercises no control over those sites and disclaims all liability for their content, their availability and the data processing they carry out.

Linking to the platform is free for fair, non-commercial use, to the exclusion of any use suggesting a partnership with or endorsement by Pambe.

7. Reporting unlawful content

In accordance with Regulation (EU) 2022/2065 on digital services, any person may report content they consider unlawful, using the “Report” button on profiles and service listings, or by email to info@pambe.be.

The single point of contact for users, Member State authorities, the European Commission and the European Board for Digital Services is: info@pambe.be. Communications may take place in French, Dutch or English.

Every report is examined diligently, objectively and non-arbitrarily. The reporter and, where applicable, the user concerned are informed of the decision taken, its reasons and the available means of redress. The full procedure is set out in article 12 of the terms of use.

8. Dispute resolution

Any complaint must first be addressed to info@pambe.be.

A consumer who does not obtain satisfaction may refer the matter free of charge to the Consumer Mediation Service, boulevard du Roi Albert II 8 box 1, 1000 Brussels (consumerombudsman.be), or file a report with the Federal Public Service Economy through its online reporting point.

For any question relating to data protection, a complaint may be lodged with the Data Protection Authority, rue de la Presse 35, 1000 Brussels.

9. Governing law and jurisdiction

The platform and this legal notice are governed by Belgian law.

Failing an amicable settlement, the Belgian courts have jurisdiction. Consumers retain the benefit of the mandatory rules and the protective jurisdiction rules of their place of residence.
